Antitrust & Trade Regulation

The Pennington Firm provides training, counsel, and representation to businesses and nonprofit organizations (including trade associations) on all aspects of Federal and Florida antitrust and trade regulation law. The issues involved in this practice area include price fixing, bid-rigging, divisons of markets, group boycotts, and other anticompetitive agreements, as well as conspiracy, monopolization, price discrimination, mergers/acquisitions, unfair methods of competition, and unfair/deceptive trade practices. The laws involved include the following:

  • Clayton Act
  • Hart-Scott-Rodino Antitrust Improvements Act of 1976
  • Federal Trade Commission Act
  • Florida Antitrust Act of 1980
  • Florida Deceptive and Unfair Trade Practices Act
  • Robinson-Patman Act
  • Sherman Antitrust Act of 1890

The firm provides representation in connection with investigations and enforcement by the Antitrust Division of the United States Department of Justice, the Federal Trade Commission, and the Florida Attorney General's Office. The firm also provides representation in State and Federal courts in private suits, including complex multi-district class action litigation.
