Shareholders Michael J. Thomas and Chase E. Boswell recently successfully defended a medical malpractice case in Leon County, Florida. The plaintiff alleged that her orthopedic surgeon and physician assistant breached the standard of care in the pre- and post-operative management of a total ankle arthroplasty, Achilles lengthening, and second and third hammertoe correction procedure. The plaintiff alleged these failures resulted in her right below-knee amputation.
The case was tried against the orthopedic surgeon and physician assistant over a five-day period, and resulted in a defense verdict for the physician assistant, and a hung jury for the orthopedic surgeon. The plaintiff appealed this decision up to the First District Court of Appeal for review, including the Court’s entry of an order awarding costs. On May 4, 2023, the First DCA issued a per curiam opinion affirming the trial court’s ruling, including the award of costs against the plaintiff and in favor of the physician assistant.
